A 55-year-old Texas man, Russell Niemeier, has been sentenced to 14 years in prison after breaking into his mother’s home and threatening to kill her while armed with a knife. The sentence was handed down by the 451st District Court of Kendall County, with Judge Melvin “Rex” Emerson presiding over the case.
What Happened Leading Up to the Prison Sentence?
On July 14, 2024, the Boerne Police Department responded to a call reporting a man attempting to enter the back of a residence armed with a knife. Upon arrival, law enforcement officers determined that Niemeier intended to commit theft while unlawfully entering the home, which belonged to his mother.
It was clear from the investigation that Niemeier had forcibly entered the house, confronting his mother and making threatening statements that instilled fear for her safety. Some of the threatening remarks included, “You better be ready, I’m coming for you,” and “I will choke you with your lying tongue.”
His Mother Had Been Preparing for an Attack
The victim, Niemeier’s mother, had already been living in fear due to previous incidents with her son. She had set up cans in front of her door at night to alert her if he tried to break in again. This precaution highlights the extent of her concern for her safety.
When officers arrested Niemeier, he was found carrying a Gerber folding knife and a small hatchet, further showing his intent to harm.
Previous Violent Charges on His Record
Niemeier was no stranger to violent behavior. In October 2017, he had been convicted in Kendall County, Texas, for injury to a child, elder, or disabled person. This history of violent actions contributed to the severity of his sentencing.
The Sentence and Recommendation
Probation Officer Casarez recommended that Niemeier serve a 14-year sentence in the Texas Department of Criminal Justice – Institutional Division. Given Niemeier’s past record and the dangerous nature of his actions, the judge ultimately sentenced him to prison, where he will remain for the foreseeable future.
