Texas law has undergone significant changes in recent years to protect dogs from inhumane outdoor tethering. As of January 18, 2022, it is illegal to leave your dog chained outside under most circumstances, and violators can face criminal penalties.
What Does the Law Prohibit?
- Chains and Heavy Weights: The use of chains or restraints with heavy weights to tether a dog outside is strictly prohibited. Owners must not use chains or any restraint that could cause pain or injury to the animal.
- Restraint Length and Fitting: Any restraint used must be at least five times the length of the dog (from the tip of the nose to the base of the tail) or a minimum of 10 feet, whichever is greater. The collar or harness must be properly fitted and designed for dogs.
- Shelter and Care Requirements: If a dog is left outside and unattended, the owner must provide:
- Adequate shelter that protects from inclement weather and extreme temperatures
- Shade from direct sunlight
- Potable drinking water
- An area free from standing water and excessive animal waste
Penalties for Violations
- First Offense: Violating the law is a Class C misdemeanor, punishable by a fine of up to $500.
- Repeat Offenses: Repeat offenders may be charged with a Class B misdemeanor, which can result in up to 180 days in jail and/or a fine of up to $2,000.
Enforcement Changes
Previously, authorities had to give dog owners a 24-hour warning before taking action. The new law eliminates this requirement, allowing law enforcement to intervene immediately if a dog is found in illegal or inhumane conditions.
Exceptions to the Law
There are specific exceptions, including:
- Temporary restraint during certain activities (e.g., camping, public recreational areas)
- Dogs assisting with farming, herding, or hunting
- Dogs in open-air truck beds while the owner completes a temporary task

Some Texas cities may have additional restrictions or requirements regarding pet tethering, so always check local laws as well.
